Posted By Thomas Kennedy We carry out regular inspections and repairs of communal housing areas i.e. pavements, pathways, stairs, car parks etc. A question been asked is to what extent a paving slab or kerb has to be uneven before it has to be repaired. I've read via a "blame claim" web site a figure of 25mm depth being quoted as being considered hazardous enough by the courts for a claim to succeed. Of course they mention that smaller defects can succeed too , although these are less likely! Any views on this? Has anyone derived any guidelines they would care to share. Thanks. Tommy

Posted By Alan Hoskins I would suggest that it is as relevant how long a defect has been present. If you have a regular inspection regime and can prove it, you are more likely to succeed in rebutting a claim. Alan
