At 6am on 26th March, Smoking in substantially enclosd public places become illegal in Scotland. That includes all workplaces and makes designated smoking rooms illegal. What are other Scottish companies doing to meet the regs? It seems to me that the best option is to make the site no smoking from the main gate onwards (as we are a higer tier COMAH Site) but I would be intrested in my learned friends opinions and their answers to the challenges this legislation poses.

Not forgetting the fact that smoking shelters that are more than 50% enclosed will be breaking the new law as well. We're waiting for a bit longer before deciding a strategy. However, it seems like signs, butt bins, signs, enforcement and more signs is the way ahead.

Just realised that our new smoking shelter purchased a few months ago will be illegal in March! I obviously didn't do my research properly -looks like a few perspex panels will have to be removed.

We are a housing association and provide support to clients in a range of properties from small group homes to 24 hour supported flats for people with alcohol and drug addictions. I am finding the guidance very sketchy and vague. Apparently the Care Commission will be issuing further guidance this month - can't wait!

With food sites we have always limited smoking to one place, a designated smoking room, with the new requirements we are being forced to place the smokers outside. This will look bad if we place them near the main entrances, or is likely to lead to abuse if we require the smokers to go to a less visible area as we operate 24 hrs a day.
If we were to ban smoking on site I am sure we will have other problems, as well as increasing our fire risk we would upset many of the staff.
Has anyone any ideas how to comply while not upsetting staff or putting their safety at risk? Their health we are trying to address with support to stop smoking

Some additional guidance is published today, mainly relating to places where people live, and those who provide accomodation, but also covering some of the issues raised above. It's available at http://www.clearingtheai...ke%20Free%20Scotland.pdf

Happy holiday reading!

Following a review by myself we are implementing the Guidance available at http://www.scotland.gov....s/2005/11/07145408/54084 We are providing a sheltered area outside for smokers (<50% wall area so may still be a bit chilly in the middle of an Edinburgh winter) and also providing help in giving up smoking using a proprietary method (which I assume I can't name here) of which I have had good reports.
Hopefully these two actions will make our smokers a bit less disgruntled and more inclined to comply with the law.
