Asbestos management (novice needs your help)

Posted By John Mac Carthy Hi all :) I need some advice regarding asbestos and its safe management. I’m no more trained in asbestos management than any other average safety person and would consider my knowledge based on the CAW regs only. I want to know how the CAW regs are put into practice from an H&S management perspective. Scenarios: (1) Working in other people’s commercial/domestic premises as a maintenance contractor. What do I need to do and would I be classified as a duty holder? My client has never shown me an asbestos plan and I have never seen items marked up on site as the client insists it would cause a scare and encourage the claim culture. I still want a procedure or similar in place to ensure my guys are doing the right thing. (2) Major refurbishment works on a large building known to have asbestos, the asbestos is being removed by competent contractors and you are asked to manage them, what are the main points I should consider. Also Has any one got a sample asbestos management plan or other documents so as I can see what practices/precautions are put into place by others? Final certification, waste clearance and handover forms what do these look like and when do they get issued, i.e. sequence of events would be useful knowledge. Your best bet would be to do a P405 course (P405 MANAGEMENT OF ASBESTOS IN BUILDINGS. This would give you the necessary competence to be able to manage both your own staff and contractors.

It is a legal requirement for 'Duty Holders' to under Reg 4 to 'manage Asi in their premises this means in essence finding it, identifying it, assessing the risk, put a plan in place to manage and ensure people do not disturb it.
Point two ' You are legally not allowed to 'manage' per se asbestos contractors you need a licence from the HSE to do that. P405 is for general people to manage asi in their premises which would help
Point 3
Asi is removed, Independant analyst does 4 stage cleareance and issues 'certificate of reoccupation' and Waste contarctor or asi company if they remove the waste give Haz Waste Consignment note to client for his duty of care audit trail

Just a minor correction; you do not need a license to manage contractors, you need a license to supervise contractors. In fact you have a possitive duty to manage contractors whether an asbestos contractor or not.
Whilst there has been no case law defining what is meant by supervision, the HSE opinion is that 'supervisory work' means work involving any direct supervisory control over those removing, repairing or disturbing asbestos.
