Question: If we consider the Liberal Party to be the employer of Charles Kennedy would he have a case under the Disability Discrimination Act?. If any other employer treated an employee with a disability, and a drink problem is a disability, in such a manner they would almost certainly find themselves in court.

The same way that any condition that disables the body or mind is considered a disability. There are some exceptions, one of these being self tottooing.

Alcoholism is not coverd by the DDA - look at the guidance provided on this link:

Exclusions from the definition
8. Certain conditions are not to be regarded as impairments for the purposes of the Act. These are:
• addiction to or dependency on alcohol, nicotine, or any other substance (other than in consequence of the substance being medically prescribed);
• the condition known as seasonal allergic rhinitis (e.g. hayfever), except where it aggravates the effect of another condition;
• tendency to set fires;
• tendency to steal;
• tendency to physical or sexual abuse of other persons;
• exhibitionism;
• voyeurism.

Also, disfigurements which consist of a tattoo (which has not been removed), non-medical body piercing, or something attached though such piercing, are to be treated as not having a substantial adverse effect on the person's ability to carry-out normal day-to-day activities (Definition Regulations).

Does the Liberal Party have an Alcohol & Substance Misuse policy in place? If so, Mr Kennedy was within his rights to inform of his problem, as his employer they also had a duty to offer counselling/treatment to help him control his problem without fear of reprisal.

Could be a case for unfair dismissal! If it happens to the ordinary Joe Bloggs, there should be no exception for Politicians (or is there?)

Was he pushed or did he jump? Either way, I do not have any sympathies with his plight. If he had 'come clean' in the first place he may well have got the sympathy vote - honesty is the best policy.
