Hi,

I was wondering if anybody could help me out.

A members golf club employs two staff on a retainer basis and these staff also run their own businesses from the club. Whilst runing their businesses they also generate income for the club and also themselves but also employ their own staff. Who is responsible for the health and safety of the retained staff, are they responsible for themselves or are the club responsible or the club just responsible when carrying out activities that generate a profit for the club.

Also the club has a hon. secretary and a part time secretary who works twenty hours a week. Who is held responsible for health and safety and who could face prosecution as the club is owned by the members?

Hope someone could clear this up for me

In short, everyone has health and safety responsibilities under the HSWA 1974, whether they are employed, self-employed, contractor etc. The club are also responsible for the health and safety of members, guests and members of the public. You can delegate responsibilities but you cannot absolve yourself from them.

The person(s) who are deemed to be in charge of the club is the Chairman, MD if a private limited club or some other controlling person. However, your club should have a written Health and Safety Policy (signed by the proprietor or pesron in charge) that sets out Arrangements and Responsibilities, in order that everyone clearly understands their roles. Also, included in the club documentation should be risk and COSHH assessments, training, inspections, maintenance of plant and machinery, fire precautions etc.

It appears quite obvious from your questions that the club do not have in place the health and safety systems that are legally required. If you check out the R&A web site you will find a comprehensive list of h&s objectives or otherwise contact me direct and I will provide one specifically for golf clubs.
