Quick question

One of our members of staff was on business in Austria, they decided to go on tobogan run and had an accident resulting in a broken nose

Do we need to record this accident?

What would you do

Was the accident a result of a "work related activity" or was it on their own time?

If on their own time, I believe that it's no different to being in, say Wales, on business and falling over a sheep whilst taking a ramble in your own time.

Of course, there are also a range of subsidiary factors that may blur the distinctions between work and personal time. For instance, was the tobogan run closely linked with their work reason for being there is an important point to resolve.

Question answered then JAI; provided of course that it meets the requirements of a RIDDOR reportable.

..."they decided to go on a tobbogan run"

Was this a group activity ie company organised and paid for?
Or were these opportunist individuals,
who were just taking advantage of the local facilities?

No it doesn't need reporting under RIDDOR as it outside the geographical confines of the United Kingdom.

and if the toboggan run was their own idea and not part of the organised bonding activities, then they were "on a frolick", so not legally at work even though it was in work time.

However, dpending on your insurance cover, you may need to notify your travel/personal accident insurers. One of our employees in a similar situation would be covered and would be entitled to a repayment of any medical expenses incurred.

First, while the incident is not reportable under RIDDOR to the UK authorities, as it occurred outside of the UK, it will probably require reporting to the local authorities where the incident occurred i.e. you may need to report this to the Austrian equivalent of the HSE.

Second, you will still need to investigate and record the injury internally as it is a work related injury, and classify it accordingly i.e. whether it is minor, over 3-day, reportable, etc. and consider what corrective actions are required to stop it happening again.
