Need some help on the application of the Asbestos Regulations. Problem is - owner of a commercial river and coastal going vessel says that Asbestos Regulations do not apply to shipping - usual sources of information all appear to be a bit vague on this. Anyone able to clarify this?

Unusually for UK Regulations, the AaW Regs 2002 do not include the normal exclusions for the application of the Regs in Reg 1 - Application & Citation, nor in Reg 2 - Interpretation.

You have to look to Reg 26 [see below] to identify what work situations the AaW Regs apply to.

The normal limits of application under the HSWA specifically exclude ships & similar vessels except when being worked other than as a ship [for instance, berthed and non-crew members working aboard], in the absence of the normal exclusions, I would suggest that the AaW Regs were not intended to apply to ships etc when outside UK national waters rather than the wider remit of all ships etc.

I shall be happy for a more knowlewdgable person to address any inaccurracies.

AaW - Extension outside Great Britain
26. These Regulations shall apply to any work outside Great Britain to which sections 1 to 59 and 80 to 82 of the Health and Safety at Work etc. Act 1974 apply by virtue of the Health and Safety at Work etc. Act 1974 (Application Outside Great Britain) Order 2001[10] as they apply to work in Great Britain.

Sea going ships are registered from different parts of the world. Thus boats near you may have a regulator in another part of the world.
