Can somebody with the workplace regs acop please clarify are the temperature parameters 16 and 13 degree C Acop or guidance?

I have the regs, temperatures are not mentioned in the workplace regs.
As you probably know Acop has a different legal bearing compared to guidance

Temperatures are mentioned in the Regs: they must be 'reasonable'. The ACoP clarifies what a reasonable minimum temperature would be and indicates that 'reasonable steps' must be taken if the temperature is uncomfortably high.

The temperatures are not mentioned in the regulation.16 degrees for normal workrooms and 13 degrees where work involves physical effort are stated in paragraph 42 which is an ACOP paragraph not a guidance paragraph. Other people have already commented on the standing of the ACOP.

ACOP-unless you meet requirements of an ACOP, you must meet the same equally and effective standard. Failing to comply with an ACOP unless above steps are taken can be sited as an offence...............
If you want to fight your corner-it will be the Courts you will have your say.

Just to confirm that an EHO in my area did successfully prosecute a pet shop in Suffolk for this offence. It was quite funny on the TV when a unison spokesman said they had breached the regulations for the entire 80 years the company had operated.

There is separate CIBSE guidance that for sedentary work the minimum temperature should be 19 deg C.
