Question
Safety policy if I am the MD and my wife is the other MD/ owner of the company and we employ three staff. Does the company now employ five people and require a Health and Safety policy, as after all my wife and I do get paid.
If the answer is no technical by law what if I now employee loads of self-employed people to work in my office such as the accountant cleaners etc.
Whets the experts say!! PS sorry about the grammar its very early

The answer is yes you do need a policy you have to count yourself and your wife as emplyees of the 'Company' and therefor you employ5 or more people.

Hi Alan,
First of all you need a policy however many people you employ; five employees is the threshold for having to write it down. And remember that an employee is a complicated beast, and can be differently defined for different legal purposes; we have many volunteers, they are not employees for most employment law, but they are for H&S. The same could apply in some senses if you used self-employed people to try and get round legal provisions,

You can get a free leaflet from the HSE which will help with this, its called 'Stating your Business' (INDG 324) Guidance on preparing a H&S Policy for small firms. It can be downloaded from the HSE website in their free publications section.

Read these first before doing anything more is my recommendation
