Posted By EE Regarding the smoking ban that comes into force on 26th March 2006 in Scotland. Does the ban apply inside company vehicles and plant (e.g. JCB cabs)?

Posted By Gary L So, according to gham's link, an employee alone in a company van would be breaking the law if he was caught smoking. However, if 4 people were in a company car and only 2 of them were smoking, (exposing 2 non-smokers to smoke) this would be perfectly legal? Makes perfect sense!! In addition, all vehicles travelling into Scotland will have to display no smoking signs. Regards, Gary

Posted By John Webster Yes Gary, all cars (except taxis) are exempt from the regs., even if being used solely for work, yet enclosed smoking rooms/shelters at workplaces will be banned. It will also be legal to smoke on a motorbike. Perhaps one solution for providing smoke rooms is to get a few old cars parked outside to use. Looks legal. Will it now be safer to drive an open top sports car in Scotland, as the truck drivers will no longer be dropping their dog ends, and who is going to be the first entrepreneur to rent magnetic no smoking signs to English truck drivers at the border?
