Posted By John Mac Carthy Ladies & Gents After a recent read of The Regulatory Reform (Fire Safety) Order 2005 (RRO), Statutory Instrument 2005 No. 1541. I remain slightly confused on two items. (1) Responsible person: If you lease a premise, are you the responsible person, it would appear to me the RRO directs responsibility toward the landlord or managing agent and not the lessee? Understandably the lessee is the employer but won’t it depend on the wording of the lease contract? (see extract below Meaning of "responsible person") What do you think? Meaning of "responsible person" 3. In this Order "responsible person" means— (a) in relation to a workplace, the employer, if the workplace is to any extent under his control; (b) in relation to any premises not falling within paragraph (a)— (i) the person who has control of the premises (as occupier or otherwise) in connection with the carrying on by him of a trade, business or other undertaking (for profit or not); or (ii) the owner, where the person in control of the premises does not have control in connection with the carrying on by that person of a trade, business or other undertaking. (2) Training: I understand there is a requirement for the usual emergency and fire equipment training (nothing new) however I was led to believe it would also incur additional training for fire engineers (M&E sector), i.e. in relation to the SP 203 BAFE can anyone clarify how the BAFE scheme becomes a requirement and under what Reg/Act etc if any? Or is it client orientated. The company in question has 25years experience in fire alarm systems but not registered with BAFE. The SP 203 BAFE training relates to the Design, Installation, Servicing & Maintenance as four separate units and works like CORGI/NICEIC accreditations etc. I would appreciate any comments or knowledge you can share, also what is the requirement to hold BAFE accreditation i.e. is it necessary? Posted By Clive Billington Hi John, As far as I am aware, the Responsible Person can be shared by many people. Differnt people will hold different duties e.g. the engineer who fits the sounders and smoke detecyors can be understood as being on of the "Responsible persons". Clive
