Hi,
I am currently working on a project where the neighbouring premises' tin cladding acts as our site boundary. The problem lies where the tin cladding is in a state of disrepair, protruding into our land and needs to be fixed. As this is not part of our site it would not be considered as part our responsibility to make this boundary good, although it poses health and safety implications for the new tenants of our property where they could easily cut themselves etc. on the neighbouring tin cladding.
The neighbour has been approached throughout the project and refuses to fix this, and now that the project is almost complete the neighbour is now claiming that we have destroyed his tin fence and should reinstate it even though we have photogrphic evidence to prove otherwise.
Does anyone know of any regulations whereby neighbouring premises have a duty of care to ensure the safety of neighbouring tenants??? or any suggestions on what to do in such a scenario would be much appreciated.

don't assume you will not be held liable you have to co - operate with your neighbours and also anyone who shares your premises.
Have you highlighted the matter to the offending persons.
If it a risk to your staff then you should think about segregation while you sort out getting it repaired

I agree that there should possibly be some sort of segrgation until repairs, but the neighbour has been made aware of the issue right from the start... I think he mite just be trying to get a new fence out of it and by holding off until our contract is up it is his perfect time...
the problem initially occurred when we discovered ACM at the top half of his boundary. This is not protruding into our land and is of no consequence to us, but the lower half of the fence is...
