Where ie in which legislation , is it stated that a organsiation MUST have a documented safety management system ?

Don’t think the term “management system” actually appears any where, but check out Reg 5 Management of Health and Safety At Work Regs 1999 which states you must have appropriate arrangements for effective planning, organisation, control, monitoring and review, and where there 5 or more employees this must be documented.
I think that could be classed as a documented management system.

Whilst it does not specifically state that a documentd management system is required the HASAW 1974 section 2 (3) does required a written policy and arrangements to be produced and communicated to employees

2 (3) HASWA says that you must have a written statement of your general policy and " organisational arrangements for the time being in force for carrying out the policy" I guess thats pretty close to a management system.
