Posted By col Senario..... A company looks after one health and safety requirement of a hotel chain. The hotel chain chief exec suspends ALL statutory requirements for a period of three months, due to being peed off with the hotel managers using non approved companies, How do you politely inform the hotel chain that they require the relevant H & S without jepoardising the contract and keep yourself out of court if in the event of a problem arising.

Posted By AlB I don't quite understand what you mean by suspending all statutory requirements??? Surely you don't mean he's attempting to relinquish his legal responsibility? Can you clarify. I'm interested, confused and slightly concerned all at the same time.

Posted By Telstar Think you mean suspending statutory inspections Col, point out that these are done to ensure compliance with certain legislation, then tell the CE who's hands will be cuffed if a problem gets investigated & traced to this action.

Posted By Dave Wilson Is this because they are using other H&S companies when you are the 'approved' one. Its a difficult area as all consultants will attest to, how do you tell the client he is being a stupid fool without losing his business?

Posted By Liam Mc Conalogue Col, Cover yourself then at this point, or if possible find an alternative employer because a ce burying his head in the sand regarding the H&S is an extremely serious issue. If this guy is taking this stand, then make sure you don't have anything to do with proposing/implementing this course of action. Keep a written record of all similar instructions. Ask yourself this- what happens when/if the HSE/LA pay you a wee visit? will the ce attempt to pass the buck to you? Look at your duties/job description very closely regarding your responsibilities. Rather you than me here mate!
