Posted By Jasonjg I have just visited a family friend in hospital whom has managed to cause a 6 inch severe cut down her arm with scissors whilst trying to open one of those new type plastic covers you see lately around so many toys and products. The covers seem to be semi rigid and molded around the product and have no apparent easy way of opening yet seem to be coming more and more popular. What horrified me most was the fact that she only tried to do the task herself after watching her 15 year old daughter struggling with the scissors. Why is it becoming more popular for these to be used? Apparently, there are no instructions and it is left to people’s initiative to suss these out. I just want to ask the more experienced of you in these matters Is their liability in this? Why? How is it defended against? This is not a ban the plastic covers thread or anything, in fact the person hurt feels it was their fault somehow I don’t. Do you agree or disagree? Risk aversion or stupid product or in fact stupid people? I have witnessed my kids trying in vein to open these things. Luckily, my partner is a bit more patient than I am, whom would probably throw the thing at the wall after two attempts.

Posted By el nino An interesting issue but I guess we would need a test case. It is not only the scissors you used which can be sharp - I find that the plastic used is often very rigid and will have a nasty edge to it when it has been cut through with the scissors. El Nino

Posted By Merv Newman These bright, shiny, pleasingly shaped packs make an attractive point-of-sale display. But they can be a real bitch to open. I usually take scissors to two edges and then try to remove the product. Often finish up ripping it apart with my bare hands. And without wearing Kevlar gloves (we do have them, but I acknowledge that they are not standard kitchen equipment) there really is no safe way known to man to open these things. Recently had a faulty item (computer mouse) and had to return it to the shop. (in remains of original packaging, of course) Assistant seemed horrified that I had actually OPENED it before finding it to be faulty.

Posted By Jerry Lucey Is this a failure on behalf of the Packaging Company/ supplier to show 'Due Diligence'. Does Due Diligence apply here? I remember a fairly recent thread where it was established that transport companies and food companies owed their customers due diligence but I am not sure what the true definition is.

Posted By Mark Talbot Section 3 and 6 of the HSAWA ? seems reasonable that I can be supplied a stapler to my desk without risking laceration trying to unpack it.

Posted By AlB The packaginf is probably used to reduce theft. But I have taken to these packaging items with stanley knife, and of course have often had to be forceful with the knife to open the packaging. Down with these pain in the a55 things!

Posted By Mark Mace i have an eight year old son who is up for hire to anyone who wishes as he always manages to open them on the way home in the back of the car without any tools whatsoever. More seriously though this is a very interesting point, are the company who sell you the product responsible or not any one have a definitive answer.
