I read that the HSE tried to prosecute an company after one of their van drivers caused a fatal road traffic accident whilst using a mobile phone. This was apparantly because the company was deemed to 'cause or permit' the driving of the vehicle by someone who should not have been. I also read that even if you are a company who causes people to use their vehicles to to drive from one of your locations to another periodically, that you should check their driving liscences. I agree with checking the photo part, in so far as making sure they have one, but apparantly we should be checking the amount of points they have also. I think this is irrelevant, it is up to the courts to decide whether they are fit to be on the roads or not,not the employer. Also what about data protection for people who have expired bans that still appear on there licsence? They have served their ban, so why should these become common knowledge?

If you're atlking about somebody driving a van then PUWER applies, and the driver's fitness to drive is very much the concern of the employer,

Jason, have a read of the free docs on the RoSPA website re driving at work. They represent the best practice and have been developed over several years with industry and government agencies. All the time your employee is driving or in charge of a vehicle in the employer's time, he is 'at work' unless a 'work period sign off' is agreed, and the employer is responsible for H&S, so some basic and fairly siomple policies and management guidance can help protect both of you.
