Posted By Mike Herbert Does anyone out there have any experience of TUPE and how it may affect union reps if transferring from one organisation where union recognised to another that recognises other unions. A bit of an employment law question really but maybe there are union H&S reps who have come across this. thanks. mike

Posted By David Bramall Mike I havn't actually had experience of TUPE, however, I am led to believe that it is pretty worthless. On transferring to the new "organisation" you are entitled to similar terms and conditions. The problem is, after about 1 year the initial terms can be whittled away. For example, you may transfer with 25 days annual leave entitlement - after 1 year, the new organisation may reduce this to eg. 23 days on the premise that it is similar terms and conditions, likewise £30,000 salary may become £27,000, again similar conditions, bank holidays reduced, TU representation reduced etc. etc. etc. Obviously it depends on the organisation you are transferring to, they may well be honest and upstanding, although there is no absolute guarantee.
