Competent person for driving construction plant

It has been suggested to me that and individual can undertake the operation of specific plant such as JCB, dumper, FLT or Loadall etc. so long as he is deemed competent and under supervsion, but does not necessarily hold a ticket or licence for that equipment. My understanding is that this could only be under training conditions, in a training environment and more importantly via a certified trainer. I would be horrified to think that an unexperienced individual was moving heavy machinery about.
I would be greatful for guidance on this and also thoughts.
Is there something specific in writing that states what is the leagal requirement.

No, only competence. The CPCS scheme is voluntary. The best way to assure competent operation is a course. Which is accredited to a recognised body. Some directors will sign a disclaimer to state that the operation of the machine that they have seen is that of a competent operator. This then means that the machine and operator may only 'opertate' on the directors premises. But, who or which director would be foolish enough to do such a thing? Well, i have known this to be done. And what about the insurance comapnies? Also would you let and un qualified driver get into your car valued at £15K. Well some plant is valued at £30K and these drivers aren't 'qualified' as such.

I would ensure all operators of plant hold the relevant accreditation for the item. As has been suggested, it is the foolproof way of ensuring competence.
Also, I would check the competence of the training provider and keep it on file.

For what it is worth our policy on any mobile plant requires operators to have a full and valid driving license and where there is an accredited training scheme, the operator must hold the appropriate certificate. All new operators on site are supervised during the first day to satisfy ourselves that they are competent despite their certification.This extends to plant items such as pedestrian rollers.For a list of the plant for which there is an accredited training scheme we tend to use the old CTA document despite it being now defunct, it is quite comprehensive.
