Posted By Simon H Hi, would anyone happen to know if there is a 'legal' maximum time between an Incident or Accident occuring and the HSE issuing an Improvement Notice (if one was required)?
Also is there a normal time period (I know thats a difficult thing to quantifiy) for these notices to be issued, is it days, weeks or months?

Posted By ITK No because the notice is issued because of a contravention identified at the time of the visit.
For example someone injures themselves whilst manual handling, F2508 filled in ten days after IP is unable to resume normal duties for more than 3 days.
The inspector turns up whenever, asks to see the MH assssments (there are none) he asks to see training records (there are none).
Therefore at the time of his visit (not the time of he accident)he has identified two contraventions which he believes will be continued or repeated so serves two Improvement Notices.
Many more examples but I you get the drift, so no legal timeframe to serve only to appeal.

Posted By AlB The Inspector will usually set a timeframe for the improvement, and may well return on or shortly after that time is over for a re-inspection.

Posted By Dave Wilson You will find that in reality a PN will be served where there is, in the opinion of an ispector, a 'serious and imminent risk to health and / or safety' whilst an IN is usually to improve on management systems / issues to bring standards up eg Written procedures, staff training, no Asbetsos Survey / management plan / maintenance records etc and will specify a time scale to put this right, you can appeal and the IN is lifted pending the appeal but with a PN it is not lifetd as a result of an appeal and stays in force.
So no time limit after the incident
