After all the conflicting evidence I have read regarding the transitional process for compliance to the new CDM regulations, I need some guidance. If a project commences before the introduction of CDM2, is it acceptable to run it under the current regulations? I read somewhere that the new CDM regulations need to be applied retrospectively! Does anyone have any firm guidance on this?

I cannot for one moment imagine that anybody managing a major project, for example the size of £200m, would contemplate retrospectively applying CDM2 when the project started with the philosophy and intent of good project management on CDM1. How on earth would the transition apply, who would mediate and how about appointment revisions - extremely difficult, and surely a waste of valuable time and money? If CDM1 is applied from inception the project will/should run more effectively & efficiently with few (i'm talking committed project teams) if any surprises, such as buildability/design change issues etc.

Reading the latest APS Newsletter, such a suggestion doesn't appear to be mentioned.

If anyone knows/thinks otherwise i'd be interested to know.

We have spoke about this but in response to Claire i'd like to say - there has been talk about the transistional arrangements and it is still very open for debate, lots of potential legalities and implications, the main one of course being the change from PS to CDM-C. I think it's going to be a case of wait and see - the HSE have informed that they are unlikely to be heavy handed in the first six-months after CDM2 comes into force.

I am involved in organising joint seminars with the HSE re the new regs - get yourself and your clients - or your boos if he/she is a client - on one

After many meetings with the powers that be; it appears to be highly unlikely that any significant works that are ongoing when the new regs come on line will be forced to change

My advice is that there is enough info out there to act now and look to start any new activities as if the new regs are already in place

If a client is currently working to 'best practice' then they will not need to change much

Thanks for all the responses, they're really helpful. Can you let me have some further information on the HSE Workshops please? It sounds like these will be useful forums to propose these types of questions.
