Posted By anne moore Hi my husband has recently had a particulary bad bout twice this year with kidney stones. Both times he went straight to his GP to get checked out and get a doctors notes and has had xrays which showed up a few large stones. They blasted these but they still havent gone and he has been told they will be ongoing as they seem to keep developing but are causing him great pain and take a long time to pass. All in all he has been off about a month in all with both bouts and has today had to see his OHN and she demanded he sign that she could look at all his medical details because she said she could question a doctors note (basically saying she can overrule the diagnosis of his doctor) I think this is awful as my husband suffered a bad stage with depression and this woman knows this but still basically said his kidney stones should be passed in one day as her father had had kidney stones and this was the case for him. When my husband said all people pass them in different ways she said she was in all rights to question a doctors note as she said that basically he could tell the doctor he had something else and the doctor would still put it down at renal colic (kidney stones) and I cant believe a professional health adviser would act like this! My main resounding question is can this horrid woman overule a doctors note despite my husband clearly having Kidney Stones? She upset my husband very much and i was most distressed when i found out how she had been with someone known to have depression. Please someone can you advise us as she was so nasty to him we would like to make a complaint but want to know about the doctors note thing first. Thank you so much in advance Anne

First thing, you mention a 'Doctors Note' - Can I assume by this you mean that your husband is signed off sick with a std 'sick note'? If so these notes serve to ensure that your Husbands claim to SSP is genuine, that is there purpose. As such, they cannot be used to guarantee the afflicted person is actually suffering from the affliction, they are advisory based upon the information given to the GP by your husband.
Secondly, the OHN you refer is well within her rights to ask permission to contact the GP, but there is no requirement for your husband to permit this.
In this case I would perhaps offer to take her questions to the GP personally such that you can ensure the GP gives the full picture re the length of time these stones are taking to pass, rather than a confirmation 'he suffers from kidney stones' response. In this way perhaps the OHN will be educated and your husbands rights will be respected.
Perhaps of more concern is WHY these keep re-occurring, this is the real issue that should be addressed, has the GP commented on this?
From an employers perspective, you must appreciate that someone who is off sick on a regular basis is a cost to the business. From your Husbands perspective, he needs to address the causes of the stones such that his sickens is reduced as I'm sure this has an impact wider than his ability to go to work each day.

Posted By anne moore This diagnosis was from the hospital which he had his xrays after he received the initial gp's diagnosis and he has asked to find out a time period as this is extremely painful. To can assure you he doesnt have days off willy nilly but he is getting severe back pain and pain in the obvious areas. Some stages are easier than others and he can go a month or 2 with nothing and then he starts passing small ones and then the big ones start. All these come off one big one that they have tried to blast but he his still awaiting the next course of treatment after that didnt work. All last for a long time and are not nice. I'm sorry but this woman was very pushy and nasty and i just cant forgive her speaking to him the way she did when he is a good worker and has had a max of 1 month off and cant get a timeline on the condition himself! To be honest he would love to have it sorted but he is on the NHS and nobody rushes them. I dont understand how a nurse can say that someone is ill or not over a doctor he has the Standard sicknote thats issued after 1 week off and she basically called the gp a liar?
