A surveyor who is trained and experienced asbestos surveyor (Type1&2)has advised that small alteration works to residential properties do not require a type 3 to be completed as his type 1 didn't find anything he suspected as asbestos. The works are removal of timber windows, M&E alterations, removal of insulation to water tank pipes, removal of flooring, ceiling coverings, wall decorations, kitchen units, doors, coal bunkers,etc. I'm not experienced in this area but i'm in 2 minds as to what is the correct approach to this. From reading the CAWR i understand that Type3 is required for alerations and demolition works - this is what is happening here. I know the regs don't apply to domestic premises but the contractor still needs to protect his employees and residents from asbestos. Have i got the wrong end of the stick on this matter? I'm not involved in this project but want to for future reference. Any advice would be great.Thanks.

In my experience a type 1 survey is not worth the paper its written on [unless the contract for further works allow additional surveys and costings to be allowed for amongst other things and the area is strongly managed] and many type 2 surveys do not give adequate info especially around windows in older buildings

asbestos law applies everywhere that it is likely to be found especially re the environmental aspects

there is case law where persons took down their own asbestos shed in their own time & home and were prosicuted for poor practices and others where procuited where they buried their own asbestos in their own garden

'A' is a very complicated issue and must be looked at from far more that the basic CAW etc laws via H&Safety

Type 2 surveys can only identify ACMs that are exposed. There may well be packing or other uses that are hidden within the structure.

In view of the extent of the works I would have thought that a Type 3 is essential, otherwise you may get some nasty surprises as the work progresses.

Rather than a Type 3, why not commission specific sampling in and around the areas where the works are to be undertaken. A full Type 3 will be very disruptive for the residents as it will involve a lot of work to investigate in any service ducts, behind wall partitions, soffits, solums etc.

Type 3 are required for 'major' refurbishment and demolition works.

If your people will be disturbing the building fabric then you have a statutory obligation to ascertain if the work area does/does not have an asbestos product which is likely to be disturbed. A type 1 survey will not do that for you, unless you have access to all areas and all levels of wall, floors, ceilings etc.

AIB in doors / firebreaks above ceilings etc would not get picked up in a type 1 if no access to these areas
