Could I ask your advice in connection with the provision of fire wardens (Prison environment)
We are introducing courses for fire wardens and I would like to know if fire wardens are legally required under the new RRO (fire safety) regulations and the Management Regulations
The title "fire warden" may be described under another name
Thanks
April

The Management of Health and Safety at Work Regulations 1999
8. - (1) Every employer shall -
(a) establish and where necessary give effect to appropriate procedures to be followed in the event of serious and imminent danger to persons at work in his undertaking;
(b) nominate a sufficient number of competent persons to implement those procedures in so far as they relate to the evacuation from premises of persons at work in his undertaking
The Regulatory Reform (Fire Safety) Order 2005
15. —(1) The responsible person must—
(a) establish and, where necessary, give effect to appropriate procedures, including safety drills, to be followed in the event of serious and imminent danger to relevant persons;
(b) nominate a sufficient number of competent persons to implement those procedures in so far as they relate to the evacuation of relevant persons from the premises.
The two sections above are lifted from the legislation you referred to. There is no specific requirement to nominate 'Fire Wardens', 'Fire Marshals' or any other title you might wish to give them but you have to nominate someone who is competent to ensure the workplace is safely evacuated. Evacuation has to be to a place of safety, not normally an enclosed area. In your case, in a prison, there are alternative arrangements because we can't have the little blighters starting a fire thinking they may be able to escape!
