Hi All,
Apologies for the deliberate spelling mistake, but it made you look!
My query is about rail safety and the new CDM amended regs to be introduced.
Can anyone point me in the right direction for information or know how exactly railway maintenance projects or new build projects are covered by (or not covered) by the CDM regs.

My understanding of the revised CDM Regs will apply to all construction and demolition work just as the current regs; 30 days or 500 person days. Construction type work in the rail sector will also be pursuant to the new CDM regs.

I was under the impression that under the current CDM Regs the entire rail network was considered a continual site under CDM and that the term contractors work to this. Framework agreements for maintenance with Network Rail have been established and sectors of track are added to this continual plan as necessary.

With the new notification thresholds of CDM 2007, the requirements of Part 2 need to be applied to the planning and management stages, with the requirements of part 4 applying to the 'construction' phase for all works which fall within the definition of construction as defined in Part 1-(2) these can include maintenance activities.
You need to check the definition against the specific activities you plan to carryout. In addition to this, if the works involve more than 30 days or 500 man days, the additional duties of Part 3 will apply.
Due to the changes in the application of these regulations, they will apply to far more projects, which is recognised by the HSE in their Regulatory Impact Assessment (RIA).

You'll need to confirm this with someone from Network Rail. When I was at Railtrack (as it was at the time) we as PS/Client for projects would notify the HSE and CDM applied as normal. There was always some conjecture about how CDM was applied to maintenance projects. I believe that this has been cleared up and as work is rolled up in packages and framework agreements, each area or part of a route is notified as the 'constuction site' and managed as you would for any other CDM related project.
I would advise you to contact Network Rail if you need some clarification.
