Posted By cakey Could some enlightened individual please inform me as to the circumstances in which a 'deferred' improvement or prohibition notice would be used? Many thanks

Posted By Raymond Rapp Cakey I can only recall one such instance where a HSE/HMRI inspector issued a deferred improvement notice. It was where a timescale had been agreed by both parties to replace some glass roofing panels. For obvious reasons this could not be done immediatley and meanwhile interventions were put in place to make the area safe. Hope this helps. Ray

Posted By Nick Higginson Cakey An example commonly given is when a chemical reaction process is underway and it would be unsafe to halt it. Kind regards Nick

Posted By Sarah-Jane Brown You can't defer an improvement notice as an appropriate time scale should be given. A prohibition notice is rarely deferred but as earlier response said could be used if a process has started and it would be more dangerous to cease it immediately than when the process has finished.

Posted By Tony Brunskill A simple example of a prohibition notice being deferred is a Ferris Wheel. To stop the wheel would leave people stranded at the top so, the inspector would allow the process to continue until passengers have dismounted before the notice took effect. The idea is to ensure safe conditions before stopping the process.
