.... and car parks in general.

If, by design, there is a hazard that leads to damage to your car, or worse an accident to a member of the public where there is a shared car park amongst many retail shops, who is responsible?

Tricky one i know and it's been a topic on here before, but this is one of those 'things' that's got under my skin and I'm very interested in your opinions, anecdotes or advice.

Many thanks in advance, you guys never let me down.

Gordon.

Hi Gordon

The owner of the car park would have a duty of care to users. Where a car-park is shared it may well be the property of the landlord, or it may belong to the local authority, or conceivably it could belong in common to all the shops; it will however be owned by somebody,

Legal Route.

Most Retail Parks are managed for Landlords by property companies with a office on site or contact details displayed. If this does not help try speaking to a manager in one of the shops-they should know who looks after the car park.

If this fails try enquiring through the LA Environmental Health Dept.
