Hi All,

I have a wee query for the NI crew:

1) Is the The Employer's Liability (Compulsory Insurance) (Amendment) Regulations (Northern Ireland) 2006 a Health & Safety Law or an Employment Law.

I have telephoned the HSENI 3 times now and all I am getting is I will phone you back- 2 weeks later still nothing.

If possible can you give me your source.

Hi Liam,
At a guess I'd say its the same as the EL legislation in UK.

Although it was introduced in 1969 before the 1974 HSWAct it is enforced by the HSE or HSE (NI)- therefore a Health and Safety Law.

Cheers for that but I need to have this with a 100% source from NI. Although we all know NI leg comes straight from GB leg, I need to be able to give it direct from NI leg/ sourcing from NI.

I am aware of course, the HSENI police this but so far they cannot tell me if it is from the Order 78 or what the mother act of it actually is.

It seems to be a bit of a sticky one this.

Just a thought. Do the Regs themselves not include the "parent" Act? Looking at my English versions of PUWER, LOLER, Confined Spaces Regs and CASHH ACOP these all include refernce to HASAWA.

Taking my own advice the Regs include reference to :Employer's Liability (Defective Equipment and Compulsory Insurance) (Northern Ireland) Order 1972

Thuis the answer appears to be employment but I have no specific knowledge of NI law.

If you look at the 1999 Regs, they are enforced by HSENI so I am sure that the Amendment Regs will be, too.

Yes it is enforced by the HSENI, see my earlier posting, but the question was, is it Employment/H&S Law- which was confirmed by David's previous post as Employment, under the Employer's Liability (Defective Equipment and Compulsory Insurance) (Northern Ireland) Order 1972.
