Posted By mbarrett Hi all I was hoping for a little advice my employer (owner of medium sized family business) has asked if it would be OK if his son (12 years old) could come in after Xmas before the kids go back to school and do a bit of work for some money. I have looked on the HSE website and there seems to be a bit of conflicting info in one area it says no child under minimum school leaving age may be employed and another area it says the rules are different if it is a family run firm. Obviously I would not allow him to use any machinery etc but I think my employers implication was that he could do a bit of tidying up around the building and a bit of packaging (non repetitive) and general light assembly work, few nuts and bolts again non repetetive. I am very confused as to where we would stand and would be very grateful for any advice. Cheers

Posted By Ken Taylor You need to contact the DWP for the complexities of this one. I believe that it is illegal to employ any child under 13 with exceptions like acting on stage as a child and helping in a small family business but not as an employee. The permission of the LEA/school is also required but, I suspect, not always sought. There is a list of work that must not be performed by children over 13 on the business link website and this will, of course, also apply to any legal work by under 13s.

Posted By Pete48 MB, I would advise you to check with your local authority on this one, they are the enforcers here and will be able to give you the best advice. They normally "licence" employers of children in their area. It is a serious offence to employ children without proper control. In this case you need to ask them whether this would constitute employment or not, if so I doubt it will be allowed. You will also need to consider child protection matters even though it is the son of the owner. as a minimum , employees will need to be briefed on "dos and donts" in this regard. l A child is someone below the minimum school leaving age (around 16, depending on their birthday and its relation to the date school term ends). 2 Children below the minimum school leaving age must not be employed in industrial undertakings, such as factories or construction sites, except when on work experience programmes approved by local education authorities. 3 The minimum age for other employment is 14 years, but local authorities have the power to make bye-laws restricting work in certain types of premises to those above the minimum school leaving age. These bye-laws may also contain a list of light work which children aged between 13 years and the minimum school leaving age can do in non-industrial premises.
