Posted By Tony Batty Where does a Principal Contractor (PC) stand if he feels that an employee of a sub contractor should not continue on their construction site because they feel that he may be a risk to himself and of those working around him because of his age. The sub contractor is 71. Can the PC simply say that they do not want the person working on their site for this reason? I believe this does not fall under the new age discrimination legislation as he has reached the mandatory retirement age.

Posted By Bob Youel There are cases currently going through the courts that will give rulings - watch this space - During recent tests re 'suitability for deep confined space work under hard conditions' the only people that passed were >45 years old! - the young ones just could not hack it - not fit enough / stamina low etc - I headed the test team so its real info! Note that most of the law lords are >65 years old & lead the country re law - if its good enough for 1 why is it not good enough for 2 - try risk assessment
