Posted By Jonathan Sandler CMIOSH Should a travel company show a duty of care towards a person/s staying at a self catering property, advertised within one of theirs or another's magazines abroad? It has been stated that Carbon monoxide poisoning accounts for 40 deaths a year (BBC News)therefore should EU regs be changed to be brought in line with UK regs. Should this be a trading standards issue or a H&S issue? how can we, the buyer, check to ensure that the next time we go self catering the property is safe. Thanks for your thoughts. Regards

Posted By steven bentham Come on Jonathan . . The accident you refer to is dreadful but you can't expect the HSE to enforce gas safety throughout the EEC and the rest of the world! We have to accept that safety standards are not the same in the world and regulators can only enforce the law of their own state, subject of course to their own funding!!!! Should Travel Firms do more to inspect that holiday venues & standards where they send customers are the same as the UK?

Posted By Tony Brunskill Jonathon, Did the article you refer to suggest that these 40 deaths from CO were outside of the UK? I suspect not. The HSE website suggests 20 deaths per annum in domestic premises relating to CO in the UK. If those figures are accurate it suggests we in the UK should sort our act out before throwing stones. This was an immotive accident. Sadly I believe there would have been a less robust response from the enforcing authority in Greece if it had been a greek national. But the fact that tourism accounts for 15% of GDP $236 Bn (2005 Estimate) means that they are going to make a very public display of the activities of the state in dealing with this issue. Could you please provide us examples where the UK regs are better than their European cousins? I'm particularly interested in the differences between UK and German, Austrian, French & Danish legislation. Manny

Posted By Raymond Rapp The fact is many people are killed in the UK from carbon monoxide poisoning and therefore the problem is not unique to foreign countries. EU health and safety legislation is pretty much standard for all member states. Only the transposition and enforcement will vary. Although I suspect we have more stringent non-EU regs and guidance. Whether travel companies should show more diligence is a moot point. Can they be expected to check out every holiday dwelling? If they did, the cost would have to passed on to the customer. Hands up who wants to pay more for their holidays? Regards Ray
