Posted By Salus Hi John, is this a company that employs 5 or more people? You only need a Health and safety Policy if you are an employer of 5 or more people. You will probably only need risk assessments, see INDG 163 (rev2)on the HSE web site

Posted By anon1234 Whether they have 5 or more employees, having a written policy is good practice and i don't think we should discourage it. Also the 5 employee rule only exempts employers from having a written policy, not from having a policy - although I'm not sure how you would demonstarte you have a policy if it isn't written, unless you assume that all employees could be questioned on their understanding of the companies policy.

Posted By Ron Hunter INDG259 "an introduction to health & safety in small businesses" is available free as a download from hse website. It includes a Policy template suitable for any undertaking to complete. I agree that Best Practice would suggest, and all IOSH members should encourage, transparency of information in all workplaces. It takes but a few minutes to complete the template in INDG259. It's a shame some suggest or advise otherwise.

Posted By Dave Wilson Every employer is legally required to have a H&S Policy and if they employ 5 or more people it has to be written is the statutory stance, however it is always good practice to write this down. As far as the post goes have you tried to get guidance from the BBBC?

Posted By anon1234 Salus, I think you will find that what I have said is correct and is supported further down by Dave Wilson's statement. the important diffeernce with more than 5 employees is that it MUST be written down

Posted By Salus just got back in, R. Hunter What "IOSH members" should do is to give the correct advice to a thread. Not suggest, advise or go nit picking about "good practise" and how it's such a shame that others don't follow suite or think the same as me. This is obviously a very small affair, John was asking for guidance on a Policy. First things first,"does he need one"? You have to sign and enter names into certain parts of the H & S policy to take responsibility for it, this makes someone liable. There is absolutely no need for them to do this, or spend anytime on it. What they require is to identify any hazards and risks they may have and put in sensible controls to reduce those H's & R's so FAIRP
