Does anybody out there know, if there is any requirement to give smokers an external "shelter", due to excluding them from the building whilst smoking??

Are we talking about the Health Bill that is due to be enacted in July of this year? If so then my understanding is that there is no requirement for employers to provide any facilities for smokers, but if you do provide facilities then they must not be classed as substantially enclosed. Substantially enclosed premises will be defined as premises that have a roof or ceiling and openings in the walls that are less than half the total wall space. Those were the criteria listed in the condoc "Smoke Free Premises and Vehicles"

Hi, sunny Scotland here. there is no requirement to provide shelters for staff to smoke. if you do decide to erect these you will find strict guidelines: shelter should be max 50% enclosed. Your local authority planning may need to be consulted and they will give you detailed guidance on what you may or may not build. The local EHO as the enforcing authority will also be able to advise.

We haven't supplied any shelters for staff at any of our numerous locations!

Hi Andrew,

There is no requirement to allow people to smoke at work at all, and the new legislation won't change this. Employees taken employers to IT on several occasions to try and force them to provide facilities for smokers, and they have not been successful,

By the way I don't smoke necer have and have a wife with cronic asthma. Roll on April for us non smoking Welshmen.
