Smoking ban - any international office implications?

Posted By Lala I am preparing a document for the Firm I work for regarding the forthcomng smoking ban. In discussions with HR, FM and myself (H&S), we are of differing opinion as to whether the smoking ban must stretch to our International Offices. London is the Head Office. Staff from all 20 offices travel to and from London all the time and London staff are seconded to international offices very often. I am of the opinion that our duty of care to these staff should follow them abroad and therefore ban smoking in the international offices too. Does anyone have a more knowledgeable opinion?

No the legislation does not apply abroad unless that country has something similar (Eire etc).

Posted By Lala I realise it wouldn't necessarily be legislation which dictates a ban abroad, but if our Company Policy states the Firm is a non-smoking one and all the international offices follow that Firm Policy, would the ban therefore apply?

That is a decision for your company to make in that case.
You may have severe problems with local staff though as many other cultures accept smoking as a way of life. There also maybe legislation in some countries which allows the freedom of the individual. It would be best to check the country's concerned local laws.
