I want to insist that all of our LGV drivers where seat belts, all of our vehicles are relatively new and are fitted with them, Drivers seem to be under the impression that they do not have to wear them.

Does any one know of relevant applicable law.

Try the Railway and Transport Safety Act 2003
Section 110.

Section 110 was the amendment Ref The Road Traffic Act 1988 seat belt wearing exemption for household delivery and pickups.

The amendment was due to take effect in April 2004.

If your drivers are not doing house/ door to door delivery and pickup then they should be wearing the belts.

Ignorance is no defence as they say.

At a recent survey by wiltshire traffic police 75% of LGV drivers were not wearing seatbelts, they were all given on the spot fines and if it happened to any of the drivers in our company they would have been subjected to disciplinary action. If a seatbelt is fitted it must be used just the same as a tachograph.

The Motor Vehicles (Wearing of Seat Belts) (Amendment) Regulations 2005. I reckon its a 50m max travel distance. Everything else is 'belt up'. This amendment was specifically brought in to cover what is or isn't delivery and collection. Hey - i'm off to Edinburgh from Birmingham to deliver a parcel. Don't need to wear one - WRONG.

Have looked at this and there are hi-viz seatbelts out there so we can monitor them...

Thanks to all who have replied, your comments have helped me convince certain senior people within our organisation to change their view on this and compulsory wearing is now being implemented and enforced.

The references to particular pieces of law was very helpfull, it is unfortunately impossible for me to learn and read all relevant statutes, and having your help and advice is often priceless.
