Posted By Tony Brunskill Section 37 provides that where a Director, Manager, Secretary or similar officer of a body corporate, or someone purporting to act as such, commits an offence under the RSPs through consent, connivance or neglect, he as well as the body corporate, can be proceeded against. Section 36 also provides for the prosecution of third parties where their act or omission has caused the offence to be committed. Section 7 would only apply if the person in question was an employee.
