With the onset of the Health Act 2006 I need to put together a guidance document on what the implications are to managers and the workforce and a policy document on complying with the Act, specifically smoking/not smoking in the workplace. Has anyone attempted to compile such documents that I could crib from. Any help/guidance/ assistance would be greatly appriciated

Hi Being first with the smoking regs in scotland we have developed policy etc. Simply put no smoking at work, works transport etc. with a few exceptions in residential care, hospitals for mentally ill patients. you can smoke in your own car whilst traveling on business but you cant "force" anyone else/passenger going out with them on business to go if the object to inhaling 2nd hand smoke. You can supply shelters outside the premises for staff but these must meet strict guidelines. There is no onus on you to supply shelters for staff. You will find the guidance with the regs will keep you on the right track

Hi Robert

For your info. The Smokefree(Exemptions and Vehicles) Regs have been introduced into Parliament and cover mental health trusts. They will be exempt from the regulations only in that they can put into place designated smoking areas/rooms (with sufficient protection to others from passive smoking risks) until 30th June 2008. From 1st July all (and it does say all) mental health trusts will be required to be smokefree and no smoking will be permitted from patients/visitors/staff. It will also cover all mental health residential units (acute or chronic care).
