My company is employing subcontractors to work on an NHS site (a hospital). We also have our own engineers/personnel working on this site. We are responsible for the subcontractors, however our existing policy and guidance notes only apply to situations where contractors work on our premises. This situation is different. What is the flow of paperwork: subcontractor - Us - Client? An added complication is that the second phase of the project is a new-build. Does Condam affect us?

Roger, I suggest that the short answer to your query is that CDM must be applied to both phases of the Project. The Construction Phase Plan (as opposed to your Policy & Procedures) should explain the liaison and communication requirements for the Project?

I am sure you have already but I would suggest you make sure you link in with the NHS Estates staff and refer to their Guidance on safety.

We've done that, however we are dealing with private contractors all with varying HSE requirements. Quite a headache.

Assuming the works continue to run until post 6 April 07 then all construction work will deem to be under the CDM regulations 2007 - some projects notifiable some projects not - which nevertheless puts greater emphasis on the client - this being the NHS from your thread.

who is controlling/manageing these contractors onsite on behalf of the NHS?
who is the principal contractor?
whoever they are mechanisms should be in place ensuring that all contractors communicate and co-operate with each other.

Is this something you may have influence on.

Looks like we will fall under CDM regs 2007.

We have:

NHS (client)>> Main Contractor >> Subcontractor >> Us >> Our Subcontractor.

We don't have access to the Main Contractor.

In answering your thread - the flow of information in your case is Client -main Contractor - Sub-contractor - YOUR company again Sub-contractor - Your Sub-contractor.

Those who employ your company should ensure that appropriate competency is held for your workforce normally by way of a pre-qualification questionnaire and likewise for you for the contractors you employ.

This is a condition/requirement for any sub-contract relationship.

Often, a contractor may delegate the performance of all or part of the contract to other sub-contractors. In these cases it is essential to ensure that the sub-contractors are as aware as the original contractor of the site rules and safety policy.

This does not appear to be the case here.
