i have my Nebosh cert and have a job as a health and safety manager, i am about to start my NVQ4 in h&s. a friend of a friend has asked me to look round his premises and carry out some risk assessments with some recommendations and advice. i feel confident enough to do the task but............can i do this legally, do i need insurance cover in case something goes wrong, can i take payment, or am i not qualified enough to perform the task but can give 'off the record' advice. thank you in advance for your comments.

If your friend believes you are competent on the basis of a NEBOSH certificate then it's up to him to employ you as a Consultant/adviser.

On the other hand if you also believe you are competent with just the certificate then go ahead.

I recommend P I insurance is a must have, as there could be kick backs later on, also I would accept payment but base the rate on your level of experience.

I would also check with your employer as this may go against company policy for you to carry out a "foreigner".

You need to be "appointed" by the employer under the Management Regs as the "competent" person - same as for any other Consultant.

Alternatively ask your employer if they would contract out your service on this occasion. You never know, it could flourish.
May be worthwhile considering carrying out a compliance audit first though, as opposed to delving straight into risk evaluation. This would give you and your intended "client" time to sort things out if need be.

Tricky situation. If you carry out a full inspection and do risk assessments which your friend may rely on - then you must tell your friend that you have to record everything - the good and the bad with further actions which must to taken. If you don't you may be liable.

If your friend just wants a fag packet job to help him, well that's a different situation. You would of course point out all the good and bad points and make suggestions - don't put your name on paper though.

Payment - I don't see any problem in accepting a payment for time and travel etc.

Only my opinion though.
