Hi folks,
Just a quick question. With the new noise regs that came into force last April, does an employer have to commit to audiometry testing when the noise level reaches the Upper Action Value, or is it acceptable to 'offer' testing if employees want it. I seem to remember this being talked about before the regs came into force, but I don't know if anything was decided for definite.
If anyone can shed any light on this for me I would be most grateful.

What the Regulations say Nigel, goes along the lines of:
If the risk assessment indicates that there is a risk to the health of employees who are, or are liable to be, exposed to noise, such employees shall be placed under suitable health surveillance, which shall include testing of their hearing.
Doesn't answer you question though...

the guidance L108 says
"you should therefore provide health surveillance to workers regularly exposed above the upper exposure values. Where exposure is between the upper & lower values, or where employees are only occasionally exposed to noise above the upper, then you should provide health surveillance if you find out that an employee may be particularly sensitive to noise."
