Hi all,

This Act is mentioned in the CDM 07 ACOP, reference to CDM Plan Section 3 Arrangements for controlling significant site risks, sub section (i) waste. (Page 106)

Does anybody know the "given value" for a project that triggers the need for the Site Waste Management Plan (SWMP)?

I have tried the Act on Internet but can not find any mention of the amount.

It will be £250,000 if the consultation commencing this month goes forward on its current detail. The plans become law in April 2008. If you look at some of my other postings you will see it is covered on May 8th Midland Branch conference.

The intention is to clamp down on fly-tipping hence the low project value.

Some of the regs are being delayed in their implementation subject to the consultation giving shape to their wording and the guidance that is intended to be produced. The final form of the regs will actually be in the October document though. It is one of the complications with much of the environmental stuff with delayed implementation being very common.

They are also looking at this for fixed penalty fines where it is simply paperwork missing - if there are actual other offences present these will be handled separately via the normal court route. At least that was the thinking last month.

I have just been looking through the Act and note it only applies in England and Wales. Is there any indication of a similar regulation coming into force in Scotland and if not how will this be applied to CDM2007? I would imagine we will be required to comply but it will not be enforceable? Your thoughts would be appreciated
