Posted By Alex Whibley Does anyone know if the HSE or any other body publish a list of average fines for breaches of the CDM regs? Or know what level of fines usually apply for failure to appoint a planning supervisor? Thanks

Posted By db A fine for a breach of a regulation is a maximum of £5000 in a magistrates court. HSW Act is a max of £20,000 and unlimited in Crown Court

Posted By AlB I think the HSE would raise an eyebrow if you appointed a Planning Supervisor now. Appoint a CDM Co-ordinator instead.

Posted By AlB Unless you're talking about a project that has been ongoing for a while but no PS was appointed. Then they may issue a notice. This is a good question actually. What is the action history from such failings?

Posted By ddraigice It's a very rare event. Unless there has been an injury or incident (or previous advice) the majority would result in a notice. I'll check the database though...

Posted By ddraigice Under CDM 94 - 16 PR's averaging about £3000 - not including four or five cases in the crown court which were due to fatal accidents. Fines for these ranging from £10,000 - £15,000 and one of £125000. There have ben about 125 notices just on a reg 6 charge under CDM 94 but the database is not that old so there may have been more in the past.
