I thought the new regs were quite clear; if you are the sole user of a vehicle then you can continue to smoke in it, if it may be used by others in the course of your/their work then you can't.

However two clients now says they have spoken to the HSE helpline and been informed that a smoker can do so in a vehicle so long as at the time there is nobody else there. A non smoker could then be required to use it afterwards.

Perhaps they can also smoke in the works canteen so long as there's no non smokers there at the time !!!!

Before I phone up myself, has anyone else come across this?

They have been misinformed or interperated it to what they wish it to be.

The new law will require vehicles to be smokefree at all times if they are used:
To transport members of the public
In the course of paid or volutnary work by more than one person- regardless of whether they are in the vehicle at the same time.

When i spoke to smoke free england i was told a straight no and they had an answer for all the scenarios i gave them. I even asked why they did not just make it a simple no in the regs instead of beating round the bush? I just rang again in case i got a different answer and was told the same. If at some point your company vehicle will carry passengers you cant smoke in it and i doubt there is anyone out there that can say that at no point they will have a passenger in the car.

If you have a convertable that can be stowed away then you can smoke with the roof down.;-)

I think this may have deliberately misconstrued.

No smoking in vehicles which can be used by others, including taxis.

Yes, even if all the people likely to use the vehicle are smokers it is still non-smoking! The regulations do not differentiate between smoker/non-smokers, taking the stance that it is there to protect everybody (regardless of smoking habits) from the effect of other's second hand smoke.

I would suggest that your clients are telling you porkies. The HSE are not the enforcing authority so far as Smoke-free legislation is concerned. I know because I spoke to them a while ago and I referred to the local authorities who will be doing the enforcement.
