Just wondering if we would have to have smoking signs in our company cars? The law states:
"work vehicles used by more than one person and on public transport"
So am i right in thinking if the car is used by one person then a smoking sign would not be required?

Vehicles only have to be smoke free if they are not for the sole use of one person. If a vehicle is used by one person only, and does not carry passengers, then there is no need for any signage. If a vehicle is used as a pool vehicle, ie other people can use it, even if they are driving alone, then it will have to be smoke-free and will need signage.

If the vehicles in question are vans or pool cars then certainly a sign will be required. However where the vehicles are employees company cars then I think insisting on signs may be a bit OTT, unless that is these employees are required to take other employees or members of the public in these cars as part of their work.
Right I'm off to gets the kids back to work on making those "no smoking" signs!!!

As I (and others) read the regs company cars are exempt from the smoking legislation in England and Scotland; however in Wales they would be subject to the regs and would presumably therefore need signage. Pool cars, lease cars and so on on which are provided for work are classed as work vehicles, as are all vans, trucks etc,

Nope, I give up; I just went back to the (English) regs and they appear to include company cars, though I'm sure that when I read them in March they excluded private cars. Oh well, I need a holidy, which is just as well becuse I'm off work for two and a half weeks now (yippee!),

Sorry J but I can't see anywhere in the regs that states that company cars are exempt. In the Smoke-free (Exemptions and Vehicles) Regs it states that an enclosed vehicle is smoke free it is "used" in the course of ...work by more than 1 person. I would suggest that "used" would not just mean driven but would also include passengers who use the vehicle in the course of their work. Consider the situation where a sales rep takes a colleague with him/her to visit clients. Clearly this would come within the mischief that the regs are designed to tackle. In the alternative where a company car is provided as a perk and only really used to take that person too and from work and then used as if it was their own car then clearly this would not come within the regs.

Our company policy is a blanket ban for all company vehicles including cars. The no smoking sticker is placed on teh tax disc holder. For those drivers who have their own cars and are getting paid an allowance, teh smoking ban has been derestricted, however, that driver must not smoke if carrying work passengers if they object

In Scotland cars are exempt from smoke free legislation. So company cars in Scotland are exempt,not so in England. So it will make playing "Spot the Sassenach" even easier. Suppose something will be worked out for what would happen on cross border visits. The decision to exempt a "car" in Scotland has led to some head scratching, for example, driving schools cars are exempt even though they will usually have 2 occupants and are works vehicles. We have to rely on smoking policies to make cars smoke free.
