I am carrying a risk assessment on Forklifts, I have found everything on training, servicing, seatbelts etc, However I can not find if a rotating beacon is a legal requirement (only ref so far is over 25mph) and a mention of being seen and heard.

Has anyone a note of where it says it has to be fitted?

Try: Traffic Signs Regulations and General Directions 2002. but this may not apply to off highway situations.

you may find that if it was not fitted when built then it may not be required, but if one has been fitted and it's not working then it should be. To be honest the assessment could point out the need for one as part of further controls as the cost is not high o have one fitted.
