Can we legally insist on Blood tests.

Whether you can 'legally' insist on anything related to D&A testing will depend on what industry you are in e.g. the railway industry is covered by the Transport and Work Act. I suspect that is not the case and therefore you will have to provide a company policy.
Most testing (random and for cause) is done with urine samples or possibly breath testing. Blood samples are not normally taken for a number of reasons.

Having been down this route it can be a tricky one. With regards to any new recruits, you are perfectly entitled to insist on Drug and Alcohol screening, the problems arise when dealing with your existing workforce. Unless the industry you are in or the scope of work you are doing is going to change from their normal work conditions, i wouldnt fancy your chances in implementing blood tests.

Posted By Alan Haynes Coming from the railway industry, my advice is that if you don't get the agreement of the workforce/unions before implementing the policy, you will have an almost impossible task ahead of you.
