My friends across the road works as a wagon driver for a well know Freight Company and the other night he was working down in London. He has stopped at a depot to drop off a load and picked another load up and travelled to his next destination and when he has reached his new destination he has got out and opened up the back of the wagon of his wagon so the load could be taken off by forklifts. When he has looked at the load he has noticed that one of the pallets was not squared up properly and this would stop the pallet from being unloaded because of the angle it had finished up on, so he decided to push it up a bit to square it off, unbeknown to him a saw was sticking out and it has stabbed him it the chest resulting in him going to hospital. His result from the stab was for the wound to be glued and clips being applied, but if he had waited for the doctor who was due on several hours later, he would have had stitches in it; the nurse wasn’t qualified to do this. He has asked for a couple of days off to recover because of this accident and his employer has granted him holidays, which he is mad about because he wanted sick leave as it wasn’t his fault ,where does he actually stand in all this and any advice would be appreciated.

Posted By Bob Shillabeer Can you be more specific please. Why is he not signed off work and where is the injury. Also why was a nurse able to make the treatment without a doctor being present. Was the medical place he attended a hospital or a company medical centre? My understanding is if anyone is unable to work because of a workplace injury he/she would be told by a doctor and offered a sick note and told to refrain from work if that is necessary!! Why was he required to take leave? This seems to be a more of a quandry? That's why more info is needed.

He asked for a couple of days of to to help with the injury so that it would heal up so that he didn’t have to take allot of time off with sick, if he had put a sick in he would have probably had a fortnight off and he couldn’t afford to do that, as he only gets paid for the first 2 days of sick. The injury is in the left hand side of his chest, half way across his nipple and chest.
Also why was a nurse able to make the treatment without a doctor being present?
The nurse was a triage nurse and she wanted the doctor to examine it before snitchers were applied, so it was glued and clipped it. the stitches was going to be a 3-4 hour wait and he wanted to get back as the journey was 250miles away to his house.

It was general infirmary

The doctor wasn’t there she just told him if it gets inflamed or red to go and see his doctor.
Why was he required to take leave? This seems to be a more of a quandary? That's why more info is needed.
He wasn’t required to take leave he asked for leave to help with the healing process

If he wanted sick leave then he should have self certified and got paid his 2 days. Medical advice, as far as I can understand, wasn't to have time off.
Employee cant have it both ways, if hes off sick, whether its agreed or not, he is still absent. If he is prepared to take holidays then great.
Seems to be a HR issue so I would let them fight it out.
Unless of course, you are HR as well.
