Posted By Adrian Hi all I've been told that there is a set distance that we must set up our site smoking area and that the the distance is 5m from the nearest building can any one confirm please Adrian

Posted By J Knight Adrian, As far as I know there isn't a set distance; some LAs in Scotland take the view that a wall within 2m of a shelter will be counted as part of the shelter, but I think that's just a view and not based on case law or anything like that, John

Posted By Bob Youel Do not get hung up on set distances, laid down or otherwise, as its the fact that the air should be clear of smoking hazards We have 1 shelter that is >3 meters away and we are having to move it as on certain conditions smoke enters offices and we have another that is closer yet smoke never has, to date, entered an office window usage patterns are the same for both shelters Were poss we have banned smoking irrespective, so the problems re shelters has gone away from most of our sites
