Posted By D My Uncle has taken a lease within a mini shopping centre,last week we went to clean it out ready for the opening next week. The unit has two floors, a small office on the first floor and WC, there is only one set of stairs. The ground floor being open plan. We noticed that we do not have any call points or detection devices within the building,however in the external undercover areas there are detection devices and roof smoke vents. We have asked the landlord on putting in some detection, he quite clearly stated; that it is up to you to complete and link in to the main panel. Could someone please confirm this is correct, or does the landlord have to provide fire safety measures.

It is pretty normal for landlords to have this sort of stipulation within the lease...did your solicitor not identify things like this. I'm not saying that it is morally right or that you need a fire alarm or detection system, (though it is likely that you do). If the shopping centre is enclosed then the detectors in the mall will be there partly to control smoke venting etc.

Posted By Ken Taylor Your uncle will need to undertake a fire risk assessment on the premises he occupies. The need for a local alarm, automatic detection, extinguishers, etc will depend upon the nature of the use of the premises - which are under your uncle's control and not the freeholder's or the management of the Centre. There is, however, a need for cooperation and coordination with and by Centre Management.
