Do the SHE still require this form to be completed?
Is section 137 of the Factories Act 1961 still valid? or has this been repealed?
Why are the HSE only requiring the occupation of premises as a factory need to be notified?
Why does the form only look at the "mechanical power" risk as being noteworthy?
Finally, what is a factory?

Posted By Adam Hammerton Take a look at http://www.statutelaw.gov.uk/. It contains details of all legislation still on the books. Although it states there are some legislative updates that have not yet been applied to the database, Section 137 of the Factories Act appears to still be in force. Adam

Posted By steve e ashton So far as I know - yes its still in force.
It only mentions factories - because section 49 of the Offices, Shops and Railways Premises Act 1963 is also still in force and deals with any place where people are employed in offices, shops and railways premises....
And a factory (from memory - going back 26 years... ) is defined as something like a place where persons are employed for the purposes of making or adapting articles for sale....
Includes e.g. slaughterhouses, laundries, shipyard and etc etc. Get hold of a copy of Redgraves from somewhere - I'm sure there's a proper definition in there if you need it.

Posted By AlB So if the statement
"And a factory (from memory - going back 26 years... ) is defined as something like a place where persons are employed for the purposes of making or adapting articles for sale...."
is correct, then a construction site could be classed as a factory?

Posted By Robert K Lewis They were originally regarded as such - Building Operations and works of Engineering construction. The old regs were drawn up under the Factories Act
