Does anyone know of or can point me in the right direction to find if there has been any examples of prosecutions / breaches with regards to NOT performing a home worker risk assessment.
I have already checked the HSE breaches web page without joy as it seems to centre around larger output companies.
My boss seems to think there's no need for it until he sees examples of such.

Please don't get me wrong but is your boss saying unless someone has been prosecuted there is no milage in doing anything on the issue?

You may be in for a delay then: its unlikely for an organisation to be prosecuted for not doing a risk assessment for home working.
You may find it useful to look at HSE's enforcement policy document and consider if a prosecution on this topic is 'proportionate to the level or risk'.
From a safety tactical point of view, you may wish to ask yourself if this is the most serious level of risk you face?

Ok. Taking things on same subject but from a different angle, prosecutions for injury to a home worker and failure to perform a risk assessment?
I think the end result would be low but I won't know unless I do one.

There was a case of home worker involving his wife and kid into work with mercury, our tutor told us about this on NEBOSH course. Employer got prosecuted as far as I remember
